1. Agreement
These Terms of Service ("Terms") govern your access to and use of the website, services, and communications of Shredah Investment Limited, a company incorporated in the Republic of Kenya ("Shredah," "we," "us," or "our"). By accessing our website or engaging our services you agree to be bound by these Terms.
2. Our Services
Shredah offers fleet management, logistics and freight, corporate transport, vehicle leasing, GPS tracking, and fleet maintenance services across Kenya. Specific service scope, pricing, and duration are agreed separately in a written quotation, contract or service order.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under the laws of Kenya to use our services.
4. Bookings, Quotations & Payment
- Quotations are valid for 30 days unless otherwise stated.
- Confirmation of a booking is subject to vehicle and driver availability.
- Payment terms — including deposits, milestones and credit terms — are specified in the signed contract or invoice.
- Late payments may attract interest at the prevailing Central Bank of Kenya lending rate.
5. Client Obligations
- Provide accurate booking, cargo, and contact information.
- Comply with all applicable laws when using our vehicles and services.
- Not misuse leased vehicles for illegal, dangerous or unauthorised purposes.
- Report incidents, accidents or damage promptly.
6. Cancellations
Cancellation notice periods and applicable fees are set out in the individual service contract. Fuel, driver deployment and toll costs already incurred remain payable.
7. Liability
Shredah maintains valid motor and cargo insurance as required by Kenyan law. Except for liability that cannot lawfully be excluded, our total liability for any claim arising out of or in connection with the services shall not exceed the fees paid for the specific service giving rise to the claim.
We are not liable for indirect, consequential, or loss-of-profit damages, or for delays caused by force majeure (including but not limited to weather, road closures, civil unrest, pandemics, or acts of government).
8. Intellectual Property
The Shredah name, logo, wordmark, colours, website content, and all related materials are the intellectual property of Shredah Investment Limited. You may not reproduce, copy or redistribute them without prior written consent.
9. Website Use
You agree not to:
- Introduce malware, viruses or harmful code to our website.
- Attempt unauthorised access to any part of the site or its infrastructure.
- Use the site to defame, harass, or misrepresent Shredah or third parties.
10. Suspension & Termination
We may suspend or terminate services for material breach, non-payment, safety concerns or insolvency, subject to notice provisions in the underlying contract.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. The parties will first seek to resolve any dispute amicably; failing that, disputes shall be referred to arbitration in Nairobi under the Arbitration Act, 1995, or to the competent courts of Kenya.
12. Changes
We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
